I don't think that there is any possibility that July 26th will actually happen at Bloor.
For those who are going to chance it and keep their July 26th date, remember that the builder still has a
minor delay that they can impose along with a 4 or 5 day grace period... adding on 20 days to July 26th.
This is only like 1 and 1/2 months from Sept. 30th anyway....
I'm a renter, so I'll probably just take the Sept. 30th date... as much as I don't want to.

Hey there, I would try talking to them at the sales center. When my husband and I were expecting a baby and debating moving into a two bedroom they sales woman told us that they owned the townhomes across from the sales center and that she could find us a two bedroom at a good price until our unit was done. If they have one available, perhaps they will let you rent it out for a few months.

We bought in Block A and if it is not ready we will have to move our stuff into storage and look for a place to rent. I of course am going to call Rob, but if anyone has already spoken to him did he say when he will know by? I am guessing that it is a matter of the inspectors coming and giving him the green light or not for occupancy and I'm hoping that he at least knows when that will happen so we can know for sure.
I have to be honest, I would live in that place with a bulldozer in the living room if I had too and if I can't I'm hoping someone out there knows someone or somewhere we can rent for the short term.

When I spoke to Rob he
When I spoke to Rob he explained that the city requires several things to be finished before anyone, regardless of the block they are in, can occupy. Those items include paved road, sidewalks, street lights and a crash wall(berm at the back of the property). He thinks the last block will be bricked up before the July date and that the city may allow people in the completed blocks to move in despite interior work continuing on the last couple, provided the items above are in place. He also indicated that he would like to start pre-delivery inspections in mid to late June. While he didn't say it, he made it sound as though moving in around the July date is still a possibility but that he can't predict when the city will approve occupancy. Based on previous interactions with him, I don't know that any of us should hold our breath until we actually have something in writing telling us when we can move in.
Anyone planning on renting their parking spot?
If anyone is interested in renting out their parking spot let me know. We have 2 cars and 1 parking spot.... You do the math.

Got my letter via email as well. Some questions & feedback:
1. My letter starts with "we believe that your unit itself will be ready for occupancy by July 26, 2010".....I'm guessing that is a lie and all letters started that way. Am I right? Did anyone get a letter that doesn't have that written or that states their unit will not be ready by July 26?
2. I haven't confirmed the dates of when we needed to receive notice by, etc. but what it means is that if the builder has not met the date requirements for when we need to receive notice by, then I don't believe that they can delay.
3. The Sept 30th date is beyond what the builder is entitled to delay until (they only have 15 more days past the July 26 date) therefore, if the unit cannot be occupied by about Aug 10th (assuming proper notice of this datei s provided), then yes the builder is in breech of the contract.
4. Please note the above $100 max $5,000 if not a penalty - it is compensation for expenses. Therefore, if you are living rent free / haven't given your landlord notice / etc. and this change doesn't have any additional cost to you, then you won't be getting the $100 /day. Granted, if you have a good lawyer and/or builder is in breech (#3 above)....then your lawyer may be able to assist in getting you some damages / compensation.
PS. Please note that the $5000 max is 50 days x $100. Therefore, if you do need to live temporarily (hotel?) where this would be applicable.....at $100 day the 50 days would hit about Sept 15. Assuming you had $100/day in expenses, then each day after Sept 15 that you incur expenses you are losing money out of your pocket that is not covered by the standard Tarion damages. You also have to make a claim with Tarion AFTER occupancy to seek these damages and dealing with Tarion isn't a quick process.
5. To those who think there is no advantage for the builder to delay....think again. These units are estimated to be worth $60-80k more than they were sold for 3 years ago. If the builder delays past July 26 (or Aug 10) purchasers have the ability to walk away from their unit and will only get their deposit + interest (say 3% on $20-30k for 3 years this is about $2-3k in interest). So the builder could re-sell your unit at $60-80k more and only lose the $2-3k in interest they have to pay you.......are you certain the builder has no reason to delay! :)

Not all letters are the same. We're in block G, the last block and our letter states occupancy is October 29, with the opportunity to take possession sooner if the unit is ready sooner...... But it is our option to decide if the opportunity arises. The letter clearly states our unit will not be ready for the date we were advised in our last letter (July 26, 2010)
I think some of the earlier blocks got a letter like yours. The challenge for the units that are ready on july 26th is the site might not be approved for occupancy by the city as there is still construction for the other blocks. This could cause a huge issue for people who want to move into their completed units but can't. Where will they go? How long will it take? This is probably why the builder is offering the earlier blocks a september 30th occupancy to avoid the above situation.... But accepting that change may impact your ability to claim delayed occupancy compensation if you qualify. IMO, this is why the issue is so tricky.
Unfortunately for us, this delay will force us to acquire short-term rental accommodations since we sold our current residence which closes after July 26.

I just got off the phone with Robert and had a candid and straight forward conversation which was good to have. He is very approachable and will take phone calls and emails and is always cognizant to return calls promptly (he returned my call 3 times today and I was not available each time)
A few things,
1. If you are concerned about your legal rights and entitlements, call your lawyer and have them look at the contracts and letters we have received and make any concessions with them
2. Plan for occupying whenever your letter says. If you can be in earlier and this is an option it will be available, but if you need to be in later, then the option is there as well. The letter may not be clear with the way it was worded but the intention is to have everyone move in as soon as possible
3. Robert is well aware of what is written on these boards and chooses not to participate as there are numerous Anonymous comments and things will escalate quickly out of control. He is quite available via the telephone or email and I have had previous contact on numerous occasions.
4. The Registration requirements are currently being reviewed and checked off as they are completed and he does not anticipate an extended registration process. This should come as a relief to most if you are concerned about a lengthy time period of making the interim occupancy payments
5. He rest assured that he has been open and upfront throughout the process and it is not in the builders best interest to continually delay the completion of the project.
So, it will be interesting to hear what anyone's lawyers might say. I think we are all in the same boat and the Board is useful to help alleviate some of our concerns and to let our frustrations be known. I guess patience is the key and something we are all quite used to right now. I'm hoping for July 26 but am okay now with the 30th as well after our conversation.

I have been reading the threads for while now and like everyone I have been waiting to finally move into my house which we purchased 2007. I have spoken to Falus quite a few times and all I can say is that he has never told me any factual information he has just permantley lied. I called him while I was heavily pregnant in 2009 as myself and my husband were anxious to be in our house before our baby was born. He told me that we could expect to move in by christmas, a week later I received a letter saying that it had been pushed back to March, he would have known this when I spoke to him yet he obviuosly decided to take the easy route and not tell me the truth. I called him again in March as we received another letter pushing the date back to July, he told me that he had no idea that he could push back again until his lawyer told him. Now I obviously do not work in the housing industry but I do find it extremley hard to believe that he had no idea that he could push back again!
I have been patient with him I have never got angry I have just accepted that this is the way it is. However, I spoke to Falus last week and he told me that he expects us to move in July and yet again we receive another letter pushing back. I have bit my tounge for 3 years and now I no longer can read this website without getting this off my chest. If you ever call Falus please just take what he says with a pinch of salt because my experience is that he is unable to provide truthful information and he just tells you what you want to hear then sends the bad news in writing.
I now have a 7 month old son in a one bedroom apartment and because Falus told us we would be moving we missed our oppurtunity to move into a 2 bedroom. I would imagine a lot of you are in similar situations like us and I'm also sure a lot of patience has run out.
I do not think that anything I have writen has any impact on people or probably Falus but after 3 long years of having our lives on hold it feels good to voice my opinion.

I have ocupancy on 29 oct. They told me to be ready to move . I had message that the unit will be not ready to find place for another 2 weeks. I call them they told me that the unit will be ready .. I give to my laywer all my payments end had purchace content liability insurance.Then at october 28 they told me to find hotel end move my belongings to storige. After i read this blog i know that i have to have place to live end probably end up having my place for one month extra before i move there.

The Falus construction schedule mystifies me. I don't know how they make money doing things in such a scatter shot way. I hope people can settle in soon and get on with their lives and make new friends in the community.
65 day notice
I don't know if I am misunderstanding but on page 14 of the contract it lists that they only need to give us 35 days notice for the extra delay. The 65 days notice was for the last delay that we got in march.
If I am understanding properly my assumption is that they are offering for us to extend our occupancy date or the alternative is to get our deposit back and opt out. That seems like what is stipulated in the contract. Let us know after you speak with Rob about this.

I agree... the whole delayed occupancy date stuff is all confusing. I'm no lawyer either so please validate this with your real estate lawyer.
Since the builder did not extended the occupancy date 90 days before July 26, 2010, the July 26, 2010 date automatically becomes our Confirmed Occupancy date ...... and it is this date that is used for any claim for Delayed Occupancy compensation. After this time, the builder can extend major delay for upto 120 days with 65 days notice and another 15 days with 35 days notice.
We were notified on May 27 via email and the occupancy date is July 26. This is less than 65 days notice for the major delay.
On my page 14 of my purchase agreement there is a section i) and ii) which essentially state what I said above.

We know that it will be inconvenient for you to arrange for alternate housing at the last moment and as a result we would like to extend to you an option to extend the Occupancy Date for your unit until September 30, 2010. If you would prefer a slightly later closing date we are prepared to consider your request. Many people do not enjoy the experience of living amongst some level of adjoining construction activity."
From the sounds of it, this is an offer only and if I reject their offer, what happens, am I on the street.
Good to know about the Tarion Claim and this will be something I think most, if not all purchasers will be opening. It is almost better if they just cut as a cheque when they hand us the keys to avoid all these difficulties...

Wow, I'm shocked you got this for A Block. But I believe it is true that no one will be able to move into the site until all the requirements are met for the city. Even though some blocks are pretty much complete, the other unfinished ones may cause occupancy delays for the ones that are ready.
On top of this the builder may be fishing for opportunities for people to accept a delayed closing so that they can focus their resources on the units that do not accept the delay.
I highly recommend you talk to your lawyer about this. If you agree to the delayed occupancy you might not be able to file a delayed occupancy claim.

Be careful to whomever has the option of "picking" their occupancy date! This may be offered to you with the impression that it is for your convenience, but may infact just be letting the builder off the hook for compensation payments....

Well, as anticipated the next delay letter arrived via e-mail today. September 30th....

My visions of BBQing on my rooftop patio this year have been shattered.
Ours delay letter came today too.. but ours is for October 29, 2010. We are in block G (The last block). I'm assuming different Blocks are getting different dates.
This delay would classify as a major delay and the builder is required to give us 65 days notice for a major delay. Since closing was scheduled for July 26, 2010... the 65 day notice requirement has not been met by the builder.
I called Tarion and they said since they builder did not give 65 days notice for the major delay, we are entitled to Delay Occupancy Compensation of $100.00 per day upto a maximum of $5,000.00 for temporary living accomodations and other related expenses (Storage, 2nd move, etc.). I was advised that when we take possession, to open a claim with Tarion to initiate the process.
I'd rather move into our place on time but since that is not going to happen we can get some compenstation for the lack of compliance.

Do I give my 60days notice and risk the possibility of another delay or do I wait and see and then end up having two places at once to pay for? Right now I am leaning to giving my 60days notice at the end of May and if things don't pan out and they are delayed, again, then I will make alternate arrangements for the brief time period.

My wife spoke with Falus last
My wife spoke with Falus last week for an update. He was non-committal about the exact occupancy date but, said he would be drafting a letter by week's end. How he can write a letter without knowing the exact date is beyond me. He did indicate that the first two blocks would probably move in during the last week in July, which that remains to be seen. I went by on Monday and the 2nd last block is almost entirely bricked up and the last block has wiring and plumming started and framing around windows, etc.

I was reading over my BOW contract and it specifically states that prior to occupancy purchasers must provide written confirmation from a lender that sufficient financing is in place for final closing. I'm not sure how strictly that will be enforced but it looks like, despite my original comment, it's best to have a formal pre-approval done before you move in.

Has anyone gotten their pre-approval together yet? I don't want to do it too early since I don't know how long we'll be paying rent before the condo board is set. I was told that you shouldn't get pre-approved too many times or it looks bad on your credit so I want to avoid doing it twice. Bank of Canada is saying that mortgage rates may be going up a few percent in June....

I'm a BOW buyer and banker so I thought I'd offer a little info on mortages. Multiple pre-approvals will only hurt your credit if your lender pulls a credit bureau report each time, which they shouldn't need to (ask them to test on the first application and just before closing if necessary). The deduction for each enquiry is fairly minor assuming you have good credit and haven't been seeking other forms of credit recently, so it's nothing to worry about.
The Bank of Canada is only expected to raise rates 0.25% in June, which will directly impact variable rates, but is not directly tied to fixed rates.
Most banks will only guarantee you a rate for 60-90 days, which is probably too short for final closing on BOW. In my experience, final closing can take anywhere from 3 months to >1 year, depending on how well prepared the application to the city is. For what it's worth, I won't be seeking a pre-approval until after my family has moved in.

I live next to BOB. They are making some progress on the first two buildings but the third still has not gotten past the foundation. But it looks like they should be starting that one very soon. Based on BOW, it looks like it takes them about 6 weeks to do the concrete work for one building. I do not know if the 3rd block of BOB is smaller but July 23 seems questionable to me..... But who knows. If they were anticipating a major delay I think letters would of been sent out already... Based on the occupancy rules.... But I'm no lawyer

From what I have been seeing
From what I have been seeing i believe July 23ish should be possible. The last block is up and they are starting to fill it in. There are people working on the site 7 days a week. On both saturday's and sunday's i have seen and heard people working in the interiors. I think they are well into block 5 (interior) and bricking block 6.
Like many other purchasers I too am disappointed by the delays. The one good thing that came out of this delay for us is we did much better than what we initially planned on the sale of our condo. I have also started to see "for sale" listings for both BOW and BOB popping up in a few places (MLS, Kijiji & Craigslist) with asking prices 60,000+ what were initially paid.
Now we just wait and see how this all plays out. Keping my fingers crossed!

Okay just to let everyone know;
I was in the site this week and found that in this first block (The one most complete) the kitchen cabinets are in, the drywall and trim are done, the painting is done and the banisters are done.
From what I can tell, all that is left to be done from what I could see is:
The countertops need to be installed, the appliances need to be put in, Flooring (Hardwood, tile, carpet)
Unfortunately they have also installed locks on the doors and they keep them locked when they are not working on them.
So the end of July looks quite possible for some of us.

The last block (along wallace) is on the third story and the concrete portion should be done by the end of this month.
People are also working at the site 7 days a week with mostly interior work happening on the weekends.
Looks like a July 26 closing is very possible.... most likely due to the warm winter we had. Keeping my fingers crossed!!!
I spoke with the developer
I spoke with the developer back in the fall and he confirmed people could not start moving in until permits were issued by the city and that would require all work to be complete. I'm not certain that includes interior work, as I don't see interior work posing a safety concern to other residents.
I was also there last weekend and to me it appeared as though the tiles were in, just covered for protection.
How much completion
My understanding from speaking with my lawyer is that the essential services must be available to a unit in order for the city to allow it to be occupied.
This means things like water, sewer, electricty, access for emergency vehicles and parking must be complete.
I was by the site yesterday and spoke with one of the construction guys who was hooking up the water/ sewer system to the city supply. He said the site should be conected to the city systems by end of today.
He also said that the washers and dryers have started being put into units in the first block.

As I recall there will be approx 14 visitor parking spots within the the 351 Wallace area. No street permits for overnight will be issued for additional parking for those residing at 351 .During the day there generally is room on the surrounding streets until about 6pm.
Currently, if you behave, you can park in the church parking lot overnight as long as they don't have activities. Because of the church street parking on Friday nights and Saturday is a nightmare in the Perth Wallace area.I suspect that this may effect visitor parking at 351.
For the record the community was concerned about too many units and not enough visitor parking and brought this up at many meetings. When Railpath section 2 gets completed some visitors will have a great bike option.
Dont you all get a info sheet with this kind of stuff listed when you buy?

Looks like Ubisoft chose 24 Wallace as their new Toronto studio. They are expected to create over 800 jobs in the next 10 years. I imagine the traffic is going to increase significantly but also with that many daytime employees it should give local businesses a lift....

Davenport Village - Brownstones Phase 3
So I received the first letter yesterday from the builder advising us that the occupancy date of October 2010 has now been moved to December 10, 2010. I believe that BOB and BOW purchasers have a delay of around a year and 6 months from the initial occupany date should your final occupany date be July 2010.

is anyone who bought from these guys surprised that this letter was sent to the Davenport owners... a good rule of thumb, take your date of purchase and add 3 years and 2 months and that should be your date...if you are lucky!

I have been reading this forum since May 2009 when i bought at Brownstones on Davonport location, it has been very helpful as i was fully aware from the beginning of the much expected delays. I can't wait to move in even if it will be in one more year (....or 2).

Hello All,
The information you have provided on the builders is quite useful. I went by the salesoffice this week and was told that the Wallace project wouldbe available late July, maybe even August. The sales person wasn't very assuring of the exact date. i am a first time home buyer with a young family and do not want to go through these issues with the new development Brownstones on the Park. So far I have been told September 2011 but now I am skeptical. Also, I do believe that the sales agents are not confident in the builder themselves.
When anyone has purchased did you receive the by-laws of the townhome in your contract? I am concerned with their policies regarding the townhomes and need more info before I decide to make a decision.
Any information would be a great help.

The builder has nothing to do with this web site, except I do know they
monitor it. The forums for BOW and BOB within the site was set up by
the Web-Master as people migrated to an existing neighbourhood website
with general comments about their new purchase.
I’m disappointed about the delay also, but I’ve spoken with people who
have bought condos elsewhere, and they also experienced delays of
3-4 years before moving in. Three to four years from purchase to
occupancy seems to be the norm.
Complaining?
While we may not be in a shelter, a substantial amount of our savings is tied up in these townhouses. I can't speak for everyone, but, I have a very young family and modest resources outside of the deposit I put down on my unit. Aside from the inconvenience the situation has caused, if I encountered employment issues or serious illness I wouldn't have access to my deposit, or, the equity in the property to fall back on until we move in. On that basis it's reasonable for the buyers to discuss their feelings within this forum, just as anyone in the neighbourhood is free to vent their frustrations with graffiti, trains, politics, etc. If you aren't interested in people's thoughts about this subject stop reading the threads about the Brownstones and stick to something you do have a vested interest in.
